Terms of service

On this page
These terms explain the deal between you and HappySaid when you use our service. We have written them in plain language. Where a detail is still to be confirmed, it appears in [square brackets].
The service
HappySaid helps you collect testimonials from your customers and show them on your website, on a public proof page and in widgets. We may add, change or remove features. If we make a change that matters to you, we will tell you.
Your account
You need an account to use HappySaid. You must give us a real email address, keep your sign-in secure and tell us if you think someone else has got into your account. You are responsible for what happens under your account. You must be old enough to form a contract where you live.
Acceptable use
You agree not to use HappySaid to:
- Show testimonials that are fake, or that you have changed to mean something the author did not mean.
- Show anyone's words, name or photo without their permission.
- Upload or show illegal content, or content that harasses, threatens or misleads people.
- Send spam, or try to break, overload or get around the limits of our service.
- Collect testimonials in exchange for payment or rewards that depend on them being positive.
If you see content that breaks these rules, you can report it.
Your content and our licence
Your content is the testimonials, names, photos, logos and other material you put into HappySaid, or that your customers send to your collection page. You keep your rights in it. You give us permission to store it, process it and show it as the service requires: for example on your collection page, in your widgets and on your proof page, and in the plain-text and structured-data versions of that page.
You promise that you have the rights and the permissions needed to give us that licence.
People who give testimonials
People who send a testimonial through your collection page agree that you may show it publicly with their name. They can ask for it to be taken down, and you agree to act on that request. They can also ask us to remove it, using the removal page. We may remove content when someone makes a valid request.
Plans and billing
HappySaid has a Free plan and paid plans. What each plan includes is on the pricing page. Paid plans renew each month or year until you cancel. Our payment partner, Polar, is the merchant of record: it takes your payment and issues invoices on our behalf. Prices may change. If a price for your plan changes, we will tell you before it applies to you.
Cancelling
You can cancel at any time from the billing page. Your paid plan continues until the end of the period you have paid for, and then your account moves to the Free plan. We don't delete your testimonials when you move to Free, but some features and limits will change. Unless the law says otherwise, we don't give refunds for the part of a period you have already used. [Refund terms to be confirmed.]
Suspension and termination
We may suspend or close an account if it breaks these terms, puts other people at risk, or if we are legally required to. Where we can, we will tell you why and give you a chance to fix the problem first. To close your account, contact us at support@happysaid.com.
No promises about results
We work hard to keep HappySaid available and accurate, but we provide it "as is". We don't promise that it will be uninterrupted or error-free. We also don't promise any particular result from using it, such as more sales, a higher search ranking, or stars or any other feature in search results or in AI assistants. Search engines and AI assistants make their own decisions.
Limit of our liability
To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profit or lost data. Our total liability to you for anything arising from the service is limited to the fees you paid us in the 12 months before the event that caused the claim. Nothing in these terms limits liability that the law doesn't allow us to limit.
Governing law
[Governing law and place of dispute resolution to be confirmed.]
Changes to these terms
If we change these terms in a way that matters, we will email you at least 30 days before the change applies. If you keep using HappySaid after that, you accept the new terms. If you don't agree, contact us at support@happysaid.com to close your account.
